Chibaya.<\/p>\n\n\n\n<p>The ruling follows a prohibition order issued by the Zimbabwe Republic Police (ZRP) on April 22, blocking a CDF public meeting scheduled for April 26 at Moffat Hall in Sakubva. Police cited \u201ccredible information on oath\u201d pointing to a potential threat of disorder, invoking provisions of the Maintenance of Peace and Order Act (MOPA).<\/p>\n\n\n\n<p>The ban came after a tense closed-door pre-notification meeting between CDF representatives and police at Mutare District offices, where officers presented three affidavits from unnamed community members opposing the gathering.<\/p>\n\n\n\n<p>Concerns raised included fears of violence, disruption of peace, and possible property damage, with one affidavit suggesting tensions could arise due to differing views on Constitutional Amendment Bill No. 3.<\/p>\n\n\n\n<p>CDF leaders rejected the claims outright. Mubatsa argued the objections were an attempt to suppress constitutional freedoms, insisting the organisation had complied with all legal requirements.<\/p>\n\n\n\n<p>\u201cNo citizen has the right to deny others their constitutional freedoms to assemble and express themselves,\u201d he said during the engagement.<br>CDF lawyer Nyasha Gerald Mukonyora also challenged the affidavits as vague and unsubstantiated, demanding clarity on the alleged threats.<\/p>\n\n\n\n<p>He maintained that responsibility for maintaining law and order rests with the police, not organisers, while indicating that CDF was willing to increase its marshals from 15 to 40 \u2014 a proposal police had acknowledged.<\/p>\n\n\n\n<p>The dispute escalated into court on April 24, drawing a strong legal team for the applicants, including Advocates Chris Ndlovu and Mukonyora.<\/p>\n\n\n\n<p>Prominent constitutional lawyer Tendai Biti attended the initial session but left for Harare after state lawyers requested more time, prompting the court to reconvene at 4:30PM.<\/p>\n\n\n\n<p>Earlier attempts by state lawyers, including Mr Garwe from the Attorney General\u2019s Office, to have the matter heard on Saturday morning were resisted by Ndlovu, who argued that civil courts do not sit on Saturdays and emphasised the urgency of the case.<\/p>\n\n\n\n<p>When proceedings resumed, Ndlovu mounted a robust challenge against the police decision, arguing that authorities had effectively regulated \u2014 not prohibited \u2014 the meeting by recommending an increase in marshals.<\/p>\n\n\n\n<p>\u201cYou cannot ban a meeting that you have already given conditions to proceed,\u201d he argued, adding that the Constitution guarantees citizens the right to assemble peacefully.<\/p>\n\n\n\n<p>He further dismissed police claims of security threats, arguing there is no legal provision preventing multiple gatherings on the same day.<br>In response, Garwe defended the prohibition, telling the court that police acted within the law due to security concerns.<\/p>\n\n\n\n<p>He said about 10,000 ZANU PF supporters were expected to gather at Mutare Teachers College on the same day, posing a risk of disorder.<br>He also pointed out that ZANU PF had notified authorities earlier, on April 12, while CDF submitted its notice on April 14.<\/p>\n\n\n\n<p>But Ndlovu countered that argument, saying it was legally irrelevant and discriminatory.<br>\u201cThe law does not say if one organisation is assembling, another cannot,\u201d he said, adding that it was unjust to allow a gathering of 10,000 people while blocking a meeting of about 200 based on what he described as \u201csilly affidavits\u201d from individuals lacking intelligence expertise.<\/p>\n\n\n\n<p>Court documents show CDF sought to have the prohibition order set aside and the meeting allowed under revised conditions, including deployment of 40 marshals and police assistance to maintain order.<\/p>\n\n\n\n<p>Despite the spirited arguments, Magistrate Gumbo ruled in favour of the police, effectively blocking the meeting.<\/p>\n\n\n\n<p>The decision marks a significant setback for the CDF and underscores growing tensions in Mutare over public assemblies, particularly those linked to debates around Constitutional Amendment Bill No. 3, as authorities increasingly rely on MOPA provisions to regulate gatherings.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Fanuel Chinowaita MUTARE, April 25, 2026 \u2014 A Mutare Civil Court has upheld a police prohibition on a Constitution Defenders Forum (CDF) meeting yesterday, capping a dramatic legal and political dispute that began with a tense police engagement and ended in a late evening ruling.
